Terms of Service
These Terms of Service ("Terms") govern your access to and use of the services provided by Efficient AI Algorithms ("we," "us," "our") through algorithmsdata.io and related applications, including the Express Engine platform (collectively, the "Services"). By creating an account, purchasing a plan, or using any Service, you agree to these Terms. If you do not agree, do not use the Services.
1. What the Services are
Efficient AI Algorithms provides three product lines:
- Infrastructure & Deliverability — email-authentication diagnostics (a free DNS-based scan), a one-time remediation audit, done-for-you DMARC enforcement, and optional ongoing monitoring.
- AI Automation & Operations (Omnichannel AI) — an AI-powered WhatsApp and multichannel automation platform sold by monthly subscription that includes a volume of interactions, with overage billing for usage above the included volume.
- Data Intelligence & Hygiene — asynchronous data-processing services (including list cleaning/hygiene) billed per unit of work processed (credits).
We may add, modify, or discontinue features. Pricing and product availability are as shown on the Services at the time of purchase.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your registration information, for keeping your credentials secure, and for all activity under your account.
3. Free trial and automatic billing (Omnichannel AI)
The AI Automation platform may be offered with a free trial of 7 days or 100 interactions, whichever occurs first.
- A valid payment method is required at signup to start the trial.
- Unless you cancel before the trial ends, your subscription automatically converts to a paid plan and your payment method is charged the then-current plan price at the end of the trial period.
- You may cancel at any time before the charge through your account or by the cancellation method described in Section 8. Canceling during the trial stops the conversion to a paid plan.
4. Plans, included volume, and overage
The AI Automation platform is offered in tiers (for example $79 / $199 / $499 per month, as displayed at purchase). Each plan includes a set volume of interactions. Usage above the included volume incurs an overage charge at the per-unit rate shown for your plan; overage is calculated for the billing period and invoiced in the following billing cycle. You authorize us to charge your payment method for subscription fees and any accrued overage.
For Deliverability, fees are as displayed (a one-time audit fee, a one-time enforcement fee, and/or a monthly monitoring fee). For Data Intelligence & Hygiene, charges accrue per unit/row processed at the displayed rate. Where a pay-on-success model is offered for data processing, you are charged only for work successfully delivered, as described on the relevant Service page.
5. Payments, credits, and taxes
- Payments are processed by Stripe. We do not store full card numbers.
- Prepaid credits, where offered, are consumed as work is processed and are non-refundable. This does not affect the one-time Deliverability audit refund described on its product page (a refund if no clear gap is shown).
- Prices are exclusive of taxes. You are responsible for any applicable sales, use, VAT, GST, or similar taxes, which may be calculated and added at checkout based on your location.
6. Your content and acceptable use
You retain ownership of the business content you provide (for example menus, FAQs, service descriptions, documents, and contact lists). You grant us a limited license to process that content solely to provide the Services.
You are solely responsible for:
- the content your bot or automation transmits to end users;
- obtaining any consents required to message your contacts; and
- complying with all applicable laws and with the terms, policies, and messaging rules of WhatsApp / Meta and any other channel you connect. You must use any WhatsApp/Meta connection strictly in accordance with WhatsApp's and Meta's terms.
You may not use the Services to send unlawful, infringing, deceptive, or abusive content, to violate any third-party platform's rules, or in any way that could cause us or a channel provider to suspend or penalize accounts.
7. Service availability and disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law.
We do not guarantee uninterrupted or error-free availability. In particular, third-party channel connections (including the WhatsApp connection) depend on external providers and may require occasional reconnection or experience interruptions outside our control. We do not warrant that the Services will meet your requirements or that results (including deliverability scores or automation outputs) will be uninterrupted, complete, or error-free.
Diagnostic outputs (such as the deliverability score) are based on public DNS and are informational; they do not guarantee inbox placement or prevention of all fraud. Email authentication addresses spoofing of your exact domain and does not stop look-alike domains or already-compromised mailboxes.
8. Cancellation and refunds
- Subscriptions (AI Automation, Monitoring) may be canceled at any time; cancellation stops future renewals and takes effect at the end of the current paid period. The final period is non-refundable (no partial-period refunds).
- One-time fees (Deliverability audit, enforcement) follow the guarantee/refund terms shown on their product page (for example, a refund on the audit if no clear gap is shown; the enforcement guarantee as stated below).
- Credits: prepaid credits are non-refundable.
90-Day Enforcement Guarantee (Deliverability enforcement service only)
The 90-Day p=reject Guarantee: If within 90 days of purchase your exact domain is not at a published, enforced DMARC policy of p=reject (pct=100) with SPF and DKIM records published and correctly configured for your authorized sending services — a state verifiable from your public DNS — we will refund 100% of the $1,950 to your original payment method within 10 business days (money back, not store credit).
Client Conditions for the Guarantee: This guarantee is contingent on your timely cooperation. You must:
- Either implement the DNS records we provide, or grant us DNS management access, within 5 business days of each request. Days waiting on your action pause the 90-day clock.
- Provide a complete and accurate list of all legitimate third-party sending services your business uses (e.g., CRMs, marketing platforms, billing software).
- Not manually override, delete, or modify the DNS records we implement during the engagement without our prior written confirmation.
Scope and Exclusions: This service and guarantee cover the publicly DNS-verifiable configuration for your exact primary domain. They do not promise the prevention of all phishing or fraud. Specifically excluded:
- Look-alike domains (e.g., an attacker registering yourc0mpany.com).
- Compromised mailboxes (e.g., an attacker obtaining an employee’s password).
- Vendor limitations: if a third-party sender you use technically cannot support custom DKIM/SPF alignment, we will document this limitation, but their inability to align is excluded from the guarantee.
- Inbox placement, sender reputation, and the behavior of third-party mailbox providers are not guaranteed.
Authorization & Limitation of Liability: If you grant DNS access, you authorize Efficient AI Algorithms to modify your DNS records solely for email-authentication remediation. We use staged rollout protocols to protect your mail flow and website routing, but DNS changes carry inherent risk. To the maximum extent permitted by law, our total liability for any operational disruption, lost revenue, missed communications, or data loss arising directly or indirectly from these DNS modifications is limited to the amount you paid for this service ($1,950). We assume no liability for pre-existing DNS errors or for disruptions caused by your hosting or registrar providers. Nothing on this site or in any report is legal advice.
To claim, email support@algorithmsdata.io within 30 days after the 90-day period ends, from the email address used at purchase, referencing your order. We will verify the conditions above and process qualifying refunds within 10 business days. The Limitation of Liability stated in the Guarantee is the application, to this Service, of the general cap in Section 10.
9. Suspension and termination
We may suspend or terminate your account, with or without notice, for: non-payment; violation of these Terms or of a channel provider's rules; abuse, fraud, or security risk; or as required by law. You may stop using the Services at any time. Sections that by their nature should survive termination (payment obligations, disclaimers, limitation of liability, governing law) survive.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Services is limited to the amount you paid us for the specific Service giving rise to the claim in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations, in which case the limitation applies to the fullest extent permitted.
11. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. The exclusive venue for any dispute shall be the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms. Material changes will be reflected by updating the "Last updated" date and, where appropriate, by notice. Continued use after changes take effect constitutes acceptance.
